By joining our school, you agree to be bound by the following terms and conditions, which will allow us to provide the best service and tuition to all our students.
PHOTOGRAPHIC & VIDEO CONSENT
From time to time, we may take photographs or video footage of the classes for use on promotional material or the SHOTOKAN FUDOKAN KARATE UK website. Any photographs or video footage taken of the classes will only be used by SHOTOKAN FUDOKAN KARATE UK and will not be shared with any third party.
We like to celebrate children’s participation in activities at our clubs with appropriate images. We have simple rules about taking images—photographs and videos, whether on film or digital—which are documented and available to you upon request.
By agreeing to these terms and conditions, I give permission for the taking and/or publication of images of my child by SHOTOKAN FUDOKAN KARATE UK in respect of Martial Arts training. I am also happy for SHOTOKAN FUDOKAN KARATE UK to interview my child and use their words. I understand that my child’s photo and words may be used in posters, videos, press, magazines, the internet, and other publications to show people what SHOTOKAN FUDOKAN KARATE UK does. I understand these will only be used by SHOTOKAN FUDOKAN KARATE UK, its corporate partners, and other organisations supporting its work.
By agreeing to these terms and conditions, I confirm that my child is not subject to family, care, or legal proceedings.
We prefer to use real names, but if you do NOT want us to, please email us and let us know upon enrolment of your son/daughter. By agreeing to these terms and conditions, I confirm that I have notified SHOTOKAN FUDOKAN KARATE UK of any personal preference in the use of names/pictures.
YOU AND YOUR CHILD’S HEALTH
For most people, physical activity should not pose any problem or hazard. This questionnaire is designed to identify the small number of students for whom physical activity might be inappropriate or those who should have medical advice concerning the type of activity most suitable for them.
Common sense is the best guide in answering these few questions. Please read them carefully and inform us before enrolling in an email of any of the questions where the answer is “yes”.
Questions to you or your child (parents please answer or ask your child’s doctor):
- Has your doctor ever said that you have a joint problem, such as arthritis, that has been aggravated by exercise, or might be made worse by exercise?
- Do you have high blood pressure?
- Do you have low blood pressure?
- Do you have Diabetes Mellitus or any other metabolic disease?
- Has your doctor ever said you have raised cholesterol (serum level above 6.2 mmol/l)?
- Has your doctor ever said that you have a heart condition and that you should only do physical activity recommended by a doctor?
- Do you ever feel pain in your chest when you do physical exercise?
- Is your doctor currently prescribing you drugs or medication?
- Have you ever suffered from unusual shortness of breath at rest or with mild exercise?
- Is there any history of Coronary Heart Disease in your family?
- Do you often feel faint, or have spells of severe dizziness, or have lost consciousness?
- Do you live a sedentary lifestyle (exercise less than 3 times a week)?
- Do you know of any other reason why you should not participate in a program of physical activity?
MISSED OR LATE TRAINING FEES
By agreeing to these terms and conditions, I agree that I will pay the membership fee on the 1st of each month. Should a payment not go through, it is my responsibility to inform SHOTOKAN FUDOKAN KARATE UK immediately and pay the missed fee within the week.
Our standard procedure for missed fees with membership, financing for kit, or kit purchases is as follows:
- The failed payment is retried automatically.
- If training fees are not up to date after this, we will suspend your membership until brought up to date.
CONTACT WITH SHOTOKAN FUDOKAN KARATE UK
By agreeing to these terms and conditions, I agree that I am happy for SHOTOKAN FUDOKAN KARATE UK to phone, email, text, or write a letter to my home address with any matter regarding my son/daughter and their martial arts training. This information will include gradings, holiday camps, and important dates.
I agree to ensure SHOTOKAN FUDOKAN KARATE UK has an up-to-date email address, and I will update my subscription if any changes are made to my physical address, phone number, medical conditions, or email address. I understand that it is my responsibility, and not the responsibility of SHOTOKAN FUDOKAN KARATE UK, to ensure I have up-to-date contact information. I understand that SHOTOKAN FUDOKAN KARATE UK will contact me via the email address I have provided on the mail subscription as a full member, as this is the main point of contact.
LIMITATION OF LIABILITY
The member acknowledges that SHOTOKAN FUDOKAN KARATE UK obligations and liabilities are defined in this agreement and/or within the Regulations Applicable to All Users. The member is responsible for the consequences of any use of any of the facilities of SHOTOKAN FUDOKAN KARATE UK. SHOTOKAN FUDOKAN KARATE UK will not be liable for any indirect or consequential loss, damage, costs, expenses, theft, or damage to property, whether arising under contract or otherwise.
CANCELLED CLASSES, AFTER-SCHOOL CLUBS AND REFUNDS:
We ask all parents to carefully read this before signing up: As a general rule we do not provide refunds of any sort. This includes refunds for cancelled classes due to poor weather conditions (snow/flooding), heavy traffic, unavailability of public transport, Instructors health (unable to teach due to sickness or injury), school cancelations, hall unavailability. In the very rare event of a class being cancelled students will be invited to a nearby class to catch up on the missed class. If your child goes to an after-school club, we are governed by the school on hall availability and things like nativity preparation or parents evenings can mean a class is cancelled.
We will not provide a refund for this. Instead we will either:
- a) Try to hold the class in a smaller class room and prepare a class plan that is suitable such as a bully talk/presentation.
- b) Invite students to a local club for a free session either during term time or in one of our holiday classes.
Unfortunately, if the timing of the local clubs is not convenient for you, we are still unable to offer a refund. Schools typically cancel 3-4 classes per year as other school events take priority in the hall. For this reason, we say that after-school clubs have on average 33-37 classes per year.
Please ensure you understand and agree to the above cancellation terms PRIOR to signing up. By agreeing to these terms and conditions I agree that I fully understand and I’m happy with SHOTOKAN FUDOKAN KARATE UK rules regarding cancelled classes and refunds. I understand that refunds are not normally given.
PICK UP POLICY
We understand that unavoidable emergencies do happen, however, we would like to remind parents of our important pickup policy. Our pick up policy is as follows:
Please arrive 5 minutes before your child’s class finishes.
If you are expecting to be late due to an emergency please phone the school (If an after school club) to warn the teachers, and then please also phone us on 07983 837225. Finally, if you are able to ask a friend to help with picking your child up, please do so.
We now keep a strict log of late pickups, anything over 5 minutes late is considered a “late pickup” and unfortunately parents who continually pick up their child late from class (on 2 or more occasions) may face a membership suspension. We have updated our terms and conditions with this information. Parents understand that picking up late is a serious issue and agree that should they fail to pick up on-time on more than 2 occasions a membership suspension is put in place.
RUDE OR AGGRESSIVE BEHAVIOUR
SHOTOKAN FUDOKAN KARATE UK reserves the right to refuse admission to classes to a Customer, or to eject them from the Venue at any point, if in the Instructors reasonable opinion the Customer: is acting in a threatening or aggressive manner; uses threatening, abusive or insulting language; appears to be under the influence of alcohol and/or drugs; may be a risk to the safety of club staff, students or other parents/members; may detract from the enjoyment of other Customers; fails, when required, to produce proof of identity, age or entitlement to a concession/discount; fails to comply with instructions given by the Instructors or Warrior Academy; or is found to be in breach of these terms and conditions or statutory law. This is not limited to physical behaviour but also refers to parents who are continually rude or aggressive via email/phone. No refunds will be given to Customers who are refused entry or ejected due to their behaviour as suggested in, but not limited to, the examples shown above.
SAFEGUARDING AND CHILD PROTECTION POLICY
Everyone who participates at any SHOTOKAN FUDOKAN KARATE UK event is entitled to do so in an enjoyable and safe environment. SHOTOKAN FUDOKAN KARATE UK has a moral and legal obligation to ensure that, when given responsibility for young people, coaches and volunteers provide them with the highest possible standard of care. SHOTOKAN FUDOKAN KARATE UK is committed to devising and implementing policies so that everyone in sport accepts their responsibilities to safeguard children from harm and abuse. This means to follow procedures to protect children and report any concerns about their welfare to appropriate authorities. The aim of the policy is to promote good practice, providing children and young people with appropriate safety/protection whilst in the care of SHOTOKAN FUDOKAN KARATE UK and to allow staff and volunteers to make informed and confident responses to specific child protection issues. A child/young person is defined as a person under the age of 18 (Children’s Act 1989).
HOW TO BOOK PRIVATE TRAINING
You can book private training with an initial contact email, with your name, contact email & contact phone telling us what time/s / day/s you would like to train. We will then come back to you in regards to what availability we have for private training and if this works, we will book you in for your first private session with your appointed instructor. If both you and your instructor are happy, you can then book in sessions going forward.
CANCELLATION BY SHOTOKAN FUDOKAN KARATE UK
Where circumstances dictate, SHOTOKAN FUDOKAN KARATE UK reserves the right to alter published courses, programs, trainers, fees or venues without prior notice. In the event of a course being cancelled by SHOTOKAN FUDOKAN KARATE UK, a refund of the course fee will be made but no compensation will be paid for any additional costs incurred.
AGREEMENT, ASSUMPTION OF RISK AND WAIVER OF LIABILITY
After discussing with one or more instructors at SHOTOKAN FUDOKAN KARATE UK, the nature and type of instruction that the Academy provides to its members, I hereby certify that I have read and agreed to each of the following provisions and agree to be bound by the terms herein: These questions are regarding the student participating in the classes, this may be yourself or your son or daughter.
I understand that SHOTOKAN KARATE, FUDOKAN KARATE, SYSTEMA – RUSSIAN MARTIAL ART, SELF DEFENCE, and such other martial arts as instructors and I include in my studies at SHOTOKAN FUDOKAN KARATE UK, are martial arts — that is, systems of unarmed and armed fighting techniques.
I understand that these martial arts will require me to engage in strenuous physical exercise and activity, either individually or in participation in class with other students or instructors at SHOTOKAN FUDOKAN KARATE UK, and that the martial arts techniques which I learn at SHOTOKAN FUDOKAN KARATE UK are capable of causing minor or serious physical injury (including abrasions, bruises, bleeding, broken bones or cartilage, or other tissue or organ damage), emotional or psychological injury, death, or property damage, whenever I use them against another person or physical objects, either in class at SHOTOKAN FUDOKAN KARATE UK or elsewhere.
I understand that my participation in class at SHOTOKAN FUDOKAN KARATE UK will require me to engage in conditioning exercises, formal exercises, and other physical activities that involve a risk that I will be subject to minor or serious physical injury (including abrasions, bruises, bleeding, broken bones or cartilage, or other tissue or organ damage), emotional or psychological injury, or death as a result of these exercises and activities.
I understand that the types of injuries described in paragraphs 2 and 3 may result not only from intentional action, but also from inadvertent, negligent, or reckless action, by myself or others, including the malfunction or failure of any of the equipment or facilities at SHOTOKAN FUDOKAN KARATE UK (including pads, protectors, punching bags, and tumbling mats) and errors or mistakes in instruction or performance of fighting or defense techniques by instructors or other students at SHOTOKAN FUDOKAN KARATE UK.
I understand that the risks of any and all of the types of injuries described in paragraphs 2-4 cannot be significantly reduced or eliminated without adversely affecting, and even jeopardizing, the nature and quality of the instruction and activities at SHOTOKAN FUDOKAN KARATE UK.
I understand that neither SHOTOKAN FUDOKAN KARATE UK nor any of its owners, operators, officers, employees, instructors, students, or agents authorize me to use any of the fighting or defense techniques that I learn in my studies at SHOTOKAN FUDOKAN KARATE UK against any other person, in any circumstances other than (a) martial arts training, matches, exhibitions, or demonstrations in which my instructors and I agree I am sufficiently qualified and physically able to participate at SHOTOKAN FUDOKAN KARATE UK or elsewhere, and (b) self-defense or defense of others in a situation that involves the risk of imminent physical injury or death.
In the light of all of the foregoing understandings, I knowingly and voluntarily agree to assume all of the risks associated with participation in classes at SHOTOKAN FUDOKAN KARATE UK, including those risks described in paragraphs 2-4, and knowingly and voluntarily hold harmless, and waive any and all rights to initiate or maintain a lawsuit or otherwise seek or obtain any finding of liability against, SHOTOKAN FUDOKAN KARATE UK, and any of their owners, operators, officers, employees, instructors, students, or agents.
I intend this Agreement, Assumption of Risks, and Waiver to be binding upon any and all of my parents, children, present and former spouses.
